On Wednesday, December 5th, the University received a Notice of Hearing from the LRB advising that submissions on the appropriateness of the proposed bargaining unit will be held February 12 to 14, 2013. In late October, TWU was notified that the faculty had passed the first stage in achieving union representation. On November 9th, the Alumni Association was informed that the University received a report from the Officer of the Labour Relations Board (LRB) stating that the Christian Labour Association of Canada (CLAC) did not have the 45% support needed in order for the LRB to require an actual unionization vote by the faculty of Trinity Western. CLAC responded to the LRB with a different proposed bargaining unit (those faculty members who are proposed as part of the union). A hearing on this issue was ordered.
The LRB decided that, notwithstanding the pending determination of the appropriate bargaining unit, a vote of the CLAC-proposed membership should take place November 27 and 28. Following that vote, the ballots were sealed and will not be counted until a determination is made regarding the composition and size of the bargaining unit. The vote will only be counted if the LRB decides that that the bargaining unit proposed by CLAC is appropriate.
